Our specialised services in family businesses

We help you promote the company from generation to generation

In a family business, business and personal decisions are inevitably connected. The entry of new family members, a succession or the reorganization of assets can affect both the future of the business and the family. At Afianza Avant we help you organize both areas and prepare the replacement with time, criteria and an appropriate fiscal and legal strategy.

Our specialised services in family businesses

01

Tax Advisory

Correct planning can make a big difference when transferring the company. We review compliance with the requirements to access the exemptions and reductions applicable in Heritage, Inheritance and Donations and we plan operations in advance.

02

Accounting Advisory

A family business needs to know clearly what belongs to the business and what is part of the family assets. We organize accounting information to facilitate control, decision making and future reorganization or succession operations.

03

Payroll and HR Advisory

The incorporation of family members into the company raises issues that should be resolved from the beginning: functions, remuneration, structure and responsibilities. We help you define them and manage the work obligations of the entire team.

04

Legal Advisory

We design family protocols and coordinate them with bylaws, corporate agreements and succession planning to establish clear rules on ownership, governance, incorporation of family members and transfer of interests.

05

Financial Advisory

We value the company and analyse its economic situation to deal with a succession, a sale of shares, the departure of a family partner or a reorganization of assets with better information.

06

Growth Advisory

Growing can also mean preparing the company to continue without depending on a single generation. We help you professionalize structures, organize companies and assets and evaluate corporate operations that strengthen the family project in the long term.

—Frequently asked questions

These are the most frequently asked questions we are asked by family businesses.

What requirements must a family business meet to be exempt from the Wealth Tax?

Among other requirements, there must be an economic activity and certain participation percentages must be met: at least 5% individually or 20% jointly with certain members of the family group. In addition, requirements related to the effective exercise of management functions and the remuneration obtained for them must be met. We analyse the family and corporate structure to check if the required conditions are met.

How do reductions in Inheritance and Gift Tax work when transferring the company?

The transfer of a family business can benefit from very relevant tax reductions when certain requirements are met. Its application and scope depend on factors such as relationship, maintenance of shares and the regulations of the corresponding autonomous community. We plan for succession in advance to determine what benefits may apply and what conditions will need to be maintained later.

What legal validity does a Family Protocol have?

The Family Protocol allows establishing the rules that should govern the relationship between family, property and company, but not all its clauses automatically have the same effectiveness against third parties. To reinforce their legal value, certain agreements can be transferred to the Bylaws, formalized through agreements or elevated to public deed when appropriate. We help you coordinate all these instruments so that what was agreed upon by the family has an effective application.
